Having a Baby in Ohio can get women fired!!!

Even in the enlightened, family-friendly world of 2010, women can still get fired for getting pregnant.

In Ohio anyway, companies can fire relatively new employees who take time off for pregnancy.

Ohio Court Justices ruled 5-1 that new employees risk getting fired when they take extended leaves for any reason. It's not discriminating against women to include pregnancy leaves, they decided.

The case came before the court when a nurse in Ohio was fired from her job. The Care Center fired her because she took pregnancy leave eight months after being hired. Their policy requires employees to be on the job a full year before taking an extended leave.

It was ruled that as long as company policies apply to everyone and don't make distinctions between extended leaves for pregnancy and other medical purposes, employers are within their rights to give pregnant women the boot.



The court Justices also ruled employers can fire lactating employees who take unauthorized work breaks to express their breast milk.

Is this a major hole in Ohio law. There is no protection for women in this type of situation." While many businesses are required to accommodate pregnant workers under the federal law, small businesses with fewer than 50 employees are exempt.

Small businesses position is: "Whether or not a person's unexpected leave is due to pregnancy or a heart condition or a broken leg, those circumstances affect small businesses very differently when you have one-fifth of your work force out on leave.



So is the Ohio Law discrimination against pregnant women?

I don't see this as discrimination, when an employer hires someone, they mean they actually have to be there to work. New female employees getting pregnant right away sounds to me as they are just there to get their beneftis.

I agree with a year policy, it takes that time alone to train someone, they put a lot of money, time and effort into new employees.

Unauthorized breaks plus their regular breaks is a violation.

Everyone is to be treated the same way.

If I hired someone, and a month or two months later she told me she was pregnant, I would be furious.

The time alone interviewing prospects and training adds up to time & money wasted.
Life is just to short for drama.

Yeah, get out and go on the assembly line the next day........:mad:

Then, they should counter sue-since while she was pregnant, there were two of them working.......

Yes, the policy also cited heart problems, broken leg, seemingly any reason requiring extended leave as cause for dismissal. It discriminates against entended leave, the reason be damned!



Tough policy!!!
