Do you have stupid laws in Florida like we have in Oklahoma? I got hit in the rear once and I got out and went back to the car that hit me and opened his door. But I read the tag number. They left. The man ahead of me got a little damage. I called the cops and wrote the number down so I would not forget. When the cops got there they yelled at me for not having my car out of the street. I gave them the tag number and my license and he sat in his car and filed a report. Then he handed me a paper with his name and date and incident number and location and it had the tag number I gave him. He drove away. I called my insurance agent and she told me to wait two days then go to the police station and get a copy of the report. I did and I asked what to do with it and she told me take it to a tag agent ? I did and they gave me a copy of the transaction when that car was tagged last. She told me to take it to the DMV. I did and the lady cop there called me back to her office. She asked me what I wanted them to do. I told her I wanted them to go after him for hit and run. She handed me a paper and told me to fill out both sides. Right off I saw the question "DOB of driver. And Drivers license number. I told her it was hit and run. He did not give me any info. She just shrugged. I told her the name and address was on the sheet and they could go there or call them or send them a letter. She said "we dont do that" I told her that if I go knock on the apartment door its really likely I will get shot. I told her they have guns. She still shrugged. I went back to the tag agent and asked what insurance company covered that car. She said she could not tell me as that violates the privacy act. They really did have insurance but it did me no good since I didnt know who it was. I called my agent again and she said that if I had full coverage they would pay to fix my car but I had only liability and uninsured and medical. So I just lost and I had done nothing wrong and they had insurance. I wrote the governor and my congressmen telling them they had just passed some strange laws and needed to rescind them. I never got any response.

There was a time here the officer determined who was at fault in a wreck but now they do not. They just fill out the forms and let the lawyers fight it out. If you dont have a lawyer you are gonna lose..

this is a common situation, and you will usually get told to go after them in a civil court. i know it's unfair, we have similar problems with uninsured motorists.

Yeah, someone did tell me to do that. I did consider it. But then I got thinking about what would happen. I am not sure how they would be notified to appear in court but if they did appear or not and if I won, then its my understanding it is still up to me to collect it. These people live in an apartment and likely would move soon. And many deadbeats have bill collectors after them all the time. I really doubt I could get my money after I won. So I just let it slide. I even considered vandalizing their car but then dropped it. Their car was new but got very little damage compared to mine. The car was in her name but the man was driving. The car had been bought in Texas and now they live here so I figure they move around. Up to this point I had figured that if I was a careful driver and didnt have a wreck on my own then any damage done by someone else would be covered. Wrong! And I figured hit and run was illegal. Wrong! Live and learn I guess.

In that case, you'll need to live in Hay-on-Wye. More bookshops than people when I went. You'd be in your element LC :)

I went there for the day many years ago and it is one of the prettiest places i have been to. The Hereford area is gorgeous....am I totally off track, or does Bothwell live in Cheltenham...dam should have had a look on GFs map

Cop question:

An off-duty policeman who is moonlighting as a security officer at a 24-hour restaurant witnesses a minor misdemeanor which can only be written up by an on duty cop. Since the police office writing up the ticket did not see nor hear anything, would this be considered 'hear say'?

I once took my family to a department store that was having great sales. The parking lot was really full. I drove around and around. They had some off duty (I assume) officers working in the parking lot helping direct traffic. I saw a car back out and leave. I parked where that one came out. I did not notice that the last row when he came out was actually one row outside the marked parkings. When I first pulled in the officer glanced my way and blew his whistle. I didnt know if it was at me for sure. I was trying to be sure and he truned around again and yelled at me saying he was not going to tell me again to move my damned car.I did move but I got wondering later if he could have given me a ticket. I was told that off duty officers who work off duty carry a deputy commision? I dont know what that means.

police officers/deputies are commissioned public officials. all it means is they have police powers whether on duty or not. you don't have to be in uniform or "working" to make an arrest.

What do you think of the undercover sting operation of the "massage parlor" in which the deputies involved were told to receive sexual favors for proof? THe Sheriff released a statement saying something like, "there was a language barrier so we didnt want that to be an issue later".

I swear it happened right here where I live, have you seen the story yet? I'll find a link!
