Personally I think the best system is one that's always changing. we have no written constitution so things can change with the times and there is lot of give and take with no hard and fast rules.
That's basically what I said but put into one sentence.

This new maleable definition of torture is what's getting people upset. Society is so soft today that sleep deprivation to get life-saving information is torture now.
It's a but more than that. What the real issue should perhaps be is whether it is effective in providing accurate information or not. Most civilised societies gave up on torture because it is actually ineffective in producing reliable evidence.
