Photo's the law

Hmmm i was trying to describe something today on an online forum, it was hard with words only so i put up a photo. Somebody said you cant use other people's photographs without permission. (there's always one :rolleyes:)

Now i had thought if a photo was widely available & had no copyright on it, it was free to be used?

Whats the legalities of this, am i going to jail :wah:

Joking aside if you put a photo online & dont add a copyright to it, legally what can anyone do about it? Surely thats the risk you take if you dont protect it?

I'm anxious to see if anyone has the answer to this. I would think without a copyright, it's free to be used.

I've not spoken because the subject terrifies me - it's a minefield.

There can be explicit copyright even though no direct claim has been made but, in other circumstances, the photo' can be considered to be in the public domain and therefore copyright free.

I know Spot did a fair amount of research into copyright on text a while back - I don't know whether that would be applicable but it's an area that really needs professional advice if you are to be sure.
