That's why it is one of the branches of govenrment, they can choose whether to decide a case or not. It therefore allows the legislative branch to formulate a law for this. And the President has the final check/balance on any legislation passed.

I think that if someone becomes a citizen of the USA and wants to go and become a volunteer in our arms services, that's one thing. I think that asking an illegal to go dodge bullets and bombs so that our own children don't have to, is immoral.

Asking any child to go dodge bullets is immoral whether it be yours or anyone else's.

We went one worse though, we promised them citizenship in return for service and then turned round and told them to go home :-(

Oh it happened all right, then it was overturned due to the volume of protests it caused.
