I don't know anything about any "fits" but it concerns me that Obama's nominated someone who clearly places race and ethnicity above merit.



"I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."



And she was one that voted that a promotions test was unfair simply because the top scorers were white men, and set the entire test aside. I remember at the time that it was generally accepted that no such set aside would have happened had only non-whites made the grade.

I'm an ousider but I would speculate

1) She's a woman

2) She is hispanic-which I presume in an amercan context means she's not white.

3) she's probably catholic

From what I seen from the most conservative wing of the RNC...they are foaming at the mouth at every aspect of the judge. With Rush Limbat making the most noise.:-5

It sounds like she was bound by law to consider the testing from a legal standpoint. Considering her credentials Im sure this was strictly legalese rather than bias as your edging on implying. A reasonable assumption I believe.







The city argues that if it had gone ahead with the promotions based on the test results, it would have risked a lawsuit claiming that the exams had a "disparate impact" on minorities in violation of the 1964 Civil Rights Act.

The federal appeals court in New York upheld a lower court ruling dismissing the lawsuit.
