DENVER - The lawyer for the Colorado father who reported his son floated away in a helium balloon says his client and the boy's mother will both plead guilty to charges in the case.

Lawyer David Lane said in a statement today that Mayumi Heene will plead guilty to false reporting to authorities, a misdemeanour.

He said her husband, Richard Heene, will plead guilty to attempting to influence a public servant, a felony.

Lane says prosecutors have agreed to allow both to serve probation sentences.

The most serious of the charges recommended by Larimer County Sheriff Jim Alderden would have carried a maximum sentence of six years in prison.

they should have gotten more than just probation sentences.

Bang on there Your Hoppiness. I'm actually bloody annoyed with them. When It was happening, I watched that damn video of the balloon in the sky right up until It landed. I was so worried for that kid and all the time It was a sick hoax. If they do make any money from books and tv appearences then they should have the whole lot siezed to pay for the emergency services who responded and wasted their time. :-5

What a horrible thing to do to your child.

I think the mother was worried she may be deported so she decided to come clean.

They also were told by the judge they could not make any money from publicity about this case. It was part of the sentence.

I think that they got a fair sentence. Now someone should think about the children's welfare in all this as they have been put through a lot because their parents are IDIOTS..

The kids will stay in the parents custody too.

Larimer County District Judge Stephen Schapanski then ordered Heene to begin a 30-day jail term on Jan. 11, delaying the start of the sentence for two weeks so he can spend the holidays with his family. Schapanski allowed Heene to serve the remaining 60 days of his jail term under work release, meaning he can work during the day but spend his nights in jail.

Schapanski ordered Mayumi Heene to serve 20 days in jail after her husband completes his sentence. Her time served is flexible — she can report to jail on 10 weekends, for example — so the children are cared for, the judge said.

I think what's going to hurt the Heenes’ more is not being able to make a profit off their stunt.

This is great, that the kids will still have their parents around to take care of them, this they will need.

They are going to jail, and as well they are prevented from making any financial gain from the stunt:

I'm glad one of the conditions was that they couldn't financially benefit from their convictions . I've watched 'daddy' on tv and he likes the limelight doesn't he?

I think this family would benefit greatly if they got rid of daddy. ....Now mum has to sit around and wait for 'daddy' to finish his sentence before she goes in. .......I can see a divorce here in the making. I bet we see it on TV

I agree Fuzzy if the mother gets a backbone and leaves the man her and her children all will be much better off. I think daddy is one strange dude who has put fear in every member of that family.

I'm happy to Fuzz, no benefits allowed.
