Who's Responsible?

Post by Patsy Warnick »

I live on a Golf Course & curious to replies on who's responsible???

If the windows on my house are broken by a Golf Ball, who's responsible to replace that window?

Home Owner's Assoc. states the home owner is responsible. It's the risk you take with living on a Golf Course Really..!!?

If your in a parking lot & you hit another vehicle - is it Oh Well, that's the risk you took for being in that parking lot?

Yesterday a Golf Ball came flying through my Sky Light - hit a few things inside & landed next to my husband.

Who's responsible to replace that Sky Light/window? cost of $350.00

First let me say I'm your husband is alright!:-6

I would say the home owner is responsible.

Since you and others live on a golf course, I wouldn't think its up to the Golf Club to pay for it.

As one who has purchased several windows that I have broken on a golf course let me say for certain that the responsibility rests with the golfer that broke the window.

Typically, the golfer's home owners insurance would pay for the damages. If the golfer that broke the window cannot be found then the person that owns the home would usually be covered by their home owners insurance.

Having a direct hit through our ceiling comes this ball

sounded like a gunshot. We both looked at eachother glass flying- we're OK

and now what the Heck was that? And there's the ball.

We run out back - the Golf group pulls up - I have a note pad & Pen writing down license plate numbers - I wasn't not happy.

I told them if you can't keep the ball on the green - take up fishing....!!

Our Insurance Agent said - you don't want to claim damages, your rates would go up. great.!!

Home owners Assoc. states damages are the home owners responsibility.

Well - I don't agree

Since when can you hit a object - create damage (Vandalism) and not be responsible?

So what the heck good is home owners insurance if you can't make a valid claim. :-5

golf ball damage to property looks convincing.

more eta: it's probably just my browser state, neither of those links comes up unless I use the reload button on the page. The page really exists, honestly.

Call the insurance company and by pass your agent. Explain what happened and ask them if your rates would go up for such a claim. I really doubt it.

Knowing our Deductible is $500.00 and knowing the sky light is less, we called for estimates@ $350.00.

I called my Ins. Agent to discuss the scenario - also stated the Golfer responsible could claim this accident on his Insurance - he also stated your Ins. Rates would increase etc...

Guess who received a New Sky Light..?

The Golfer responsible arrived with the sky light AND Installed the sky light.!!

YEH - To all our Canadian Friends here on FG - The Golfer lives in Alberta and is here on vacation and was a very very nice guy. He wanted to do the right thing.

We laughed & talked had a wonderful conversation

found out we have alot in common .

Things happen for a reason and I believe my Husband & I will become good friends with Golfer & his wife.

And that is worth every cent.

I was concerned about the deducible and that your rates would of course go up, every time a claim is put in, insurance companies raise them.

I'm glad he did right thing!

My friend and I looked at his Homeowners association contract.

His states that the homeowner cannot hold liable the homeowners association, the Club or its members, or member guests responsible for accidental damage from golf balls.

However, I know that when one of the guys in our foursome took out a window of a house on the seventh hole, we (our foursome) took up a collection and paid for replacing it.

I have heard of players not paying for damage they caused, but most will.

You are living in a "free fire zone" though, so,...

and ALL HELL BROKE LOOSE...

We have young people swinging in all directions - Testosterone Tournament !!!!

This is my 3rd window in @ 5 yrs. & the most expensive so far..

Our Golf Course is @ 100 YARDS WIDE - yes WIDE - if one can't keep the ball on that green - wrong sport for ya Dude.

Patsy, you must not be a golfer or you would know that even a Pro like Tiger Woods does not always keep the ball in the fairway, even if it is 200 yds wide.

I live on a golf course in California and there are signs posted that players are responsible for home damages caused by errant golf balls. It's never been a problem in the 10 years that I have lived here.

That is a myth that rates go up when a claim is filed. It may occasionally be true of a particular company but is not the general rule. Rates go up for other reasons but not usually for a single claim. Why even have insurance if that were the case?

I thought about discussing Posting Signs with Assocation.

My Husband loves Golf, plays a round & scores @ 68.

No, I don't Golf, it's similar to Fetch & I don't do that either.

I carry a 14 handicap. The attached pic was taken last Thursday at the "Green Acres Club" in Richmond, New Zealand where I play with my Kiwi friends.
