This is the 21 year old recently charged with stealing a portable Sony Play Station and Cell Phone from a young Malaysian with a broken jaw.

What kind of sentence is this 21 year old likely to get?

I think that is about as low as you can go. I would not be opposed to a televised public caning or just stretch his freaking neck.

Well we had a home secretary recently thought that rapists should be given shorter sentences if they admitted it and said they were very sorry and is on record as stating there some rapes aren't really all that bad. New labour laid down tariffs of sentences that could be passed restricting the discretion of judges trying to cut down the number going to prison and then spent the next thirteen years complaining about the courts being lenient. The tories fiddles their expenses wholesale but none of them went to jail for fraud, No doubt this guy will get a custodial sentence since it's in the public eye. Meanwhile the tories want to evict families and take away their benefits if their children thief or cause havoc but if you are a student at oxford and cambridge that's all part of growing up, if you pinch a policeman's helmet it's all jolly good fun if you're a scroat from a council estates you are a threat to the public. and should be locked up. You can even go on to be prime minister or deputy prime minister despite a hooligan past.

There have been over two thousand arrests and courts are sitting all weekend. So much for ineffective policing. Opening fire on looters wouldnt work in the UK it would just get the rioters annoyed.

Why the furore about Ken Clarke's assessment of different categories of rape ?

While the act of rape is a major crime, anyone with half a brain can see certain instances are a greater evil than others.

I shall give two examples, both technically rape.

Example one: An estranged married couple in an attempt to heal their marriage spend an evening eating and drinking. At home they end up retiring to the marital bed, where at the last moment the wife withdraws consent.

Example two: A stranger drags a teenaged bye passer into bushes and viciously rapes her.
I thought I knew more than this until I opened my mouth

He was referring to instances when someone misreads the signals or when a woman inadvertently has led someone on. Rape doesn't have to be violent for it to be rape he seemed to suggest it was only rape when there are obvious signs of a struggle. He made it worse by also admitting in the same interview that he had never at any time consulted with women's support groups when coming up with his idea.

To clarify my position. I don't think busting a window and looting a store is anywhere near as heinous an act as what this guy did. He needs to be used as an example.

Explain to me the difference between looting a store and looting a cell phone from the back pack of the injured Malaysian. Do you consider the latter case heinous because the Malaysian was injured?

Yes, to me that's exactly it. Both are heinous acts it's just that one is far more heinous than the other. IMO.
