Any legal eagles here?

Post by Oscar Namechange »

There Is a right old to do that unfortunately my position leaves me the one to try and find a solution.

The story In brief....

A year ago, a printer was loaned to a member of a local branch of a political party. Not any old printer but thousands of pounds worth of kit that churns out 1,000 an hour.

This woman holds no official position In the party but as I do, I could be responsible for It's non return.

The fundholder of the local branch has sent 4 polite written requests for It's return only for her to say she needs It herself to promote the party but this Is holding back other area's who need the use of It.

Last week, a parallel party was formed by disgruntled ex members of this political party but In effect still under the umbrella of the original party.... waiting for the day the Chairman of the original party Implodes.... are you following?

At this meeting, this woman swore her alliegence to the parallel party and wants nothing more than the downfall of the original parties chairman.

She has just replied to a 5th request for the printer to be returned stating she Is keeping It because she needs It to promote the parallel party.

This means that the original parties Fundholder Is financially liable for It's loss and at his age, he doesn't need this.

I have written to her officially yesterday telling her that she holds no official position In the original party nor the parallel party and It was loaned to her In good faith by the original party, there-fore It can not be legally used for a parallel party.... still following?

On advice from the police, I have been advised that this Is theft and the moment I say so, they will visit her.

I don't want to do this but the question Is, who legally owns the printer?

Send the boys in. The reciept Is In the hands of the original Parties National treasurer. If he send the boys In, this woman wanting nothing more than the downfall of the original parties chairman, will make up all sorts of nonsence to the press.

So......you are still with the original party who bought the printer, sort out the receipt , email her a copy, and ask when it will be convenient to pick up said printer, mentioning that you have sought legal advice.

Done that....

She came back and said that because the parallel party is under the umbrella of the original party, the original parties assets are still the assets of the parallel party because they are one so far..

( God, I can Imagine the US members reading this :wah: )

The police just want to go round there and charge her with theft................ but.... who owns the bloody printer? It was bought with the original party funds before the parallel party was formed so in my mind, legally, It must belong to the original party.... but because the parallel party Is an umbrella of the original party, it could be argued that they share assets.

Regardless of which party owns the printer, she does not and has no right to keep it.

Write to her (or preferable get a national officer of the party like the Treasurer) officially requesting return of the parties assets and giving notice that, if the printer is not returned by xx/xx/xx then it will be deemed to be theft and reported as such to the police.

If she goes to the press then paraphrase Arthur Wellesley.

Well then........tell her you want to use the bloody thing, and could she set a time for you to pick it up.

Are these the same people you are asking me to vote for ?

Can't even work out a share scheme on a bleeding printer ?

You all need your heads knocking together................as my Mum might have said
