Michael Jackson's doctor to be charged with manslaughter

August 20, 2009 - 11:53AM

It appears that Michael Jackson's physician, Dr Conrad Murray, could be charged by police in relation to the mega-star's death within a week.

Media including Fox News and The Sun newspaper are reporting claims that the doctor will face manslaughter charges.

Michael Jackson died of cardiac arrest on June 25.

They are also reporting claims that the star's dermatologist, Dr Arnold Klein, may face medical malpractice charges in relation to Jackson's use of prescription drugs.

Fox News reported that the Los Angeles District Attorney was in talks with investigators looking at the unexpected death with a view to laying charges. Fox News said investigators had been hoping to charge Murray with second degree murder and would execute another search warrant on an LA pharmacy.

Dr Murray is believed to have told officers he gave Jackson an anaesthetic, Propofol, to help Jackson sleep hours before he died. Though Dr Murray's lawyer Ed Chernoff has "insisted Murray did not give Jacko anything that killed him".

Too many pills.

Too many yes men.

Why does this remind me so much of Elvis? He scored all kinds of prescription drugs from lots of doctors. Pills to get high, pills to come down, pills to wake up, pills to sleep, pills for weight loss, pills to poop, pills and more pills!! His doctors knew better but it was either Elvis' money or his charisma that clouded their judgement.

It'll be interesting to see what possible defence the chap can try to make, in terms of what actually happened. Like whether he consented to inject the stuff, for example, which you'd think was a pretty basic form of liability. And whether it was a medically recognized treatment for whatever condition he claims he was treating, like insomnia or pain relief perhaps.

I'm puzzled why the maximum possible sentence will only be four years. If a chap hires a professional to administer pain relief and wakes up dead then I for one would be very annoyed and want more than a mere four year sentence in recompense.

Do you know, it took me a good ten minutes to work out the reason for that. I suspect we watch different films.

I wonder whether those who watch the Thriller music video these days do so with an enhanced appreciation?

There was a frisson of excitement at the trial yesterday.Dr Shafer, who helped write the guidance on every bottle of propofol, told the Los Angeles court that Dr Murray did not know how to respond when the star stopped breathing. He said of Dr Murray's delay in calling 911: "I almost don't know what to say. That is so completely and utterly inexcusable."

The Columbia University professor said propofol should never be taken as a sleeping aid. "We are in pharmacological never-never land here, something that was done to Michael Jackson and no one else in history to my knowledge," he told the jury.

The expert in anaesthesiology also said Dr Murray had acted like the pop star's obedient "employee" and not his doctor, who should have refused the star's requests for propofol. "Saying 'yes' is not what doctors do," said Dr Shafer. "A competent doctor would know you do not do this."

Bull! "Yes" is exactly what the pharmaceutical industry wants doctors to say to their customers (the doctors "patients") when the customer marches into the doctor's office to demand the newest product they saw on TV the night before.

It may well be that a particular subset of doctors want to get wealthy while being medically trivial but it's not what we license them for. Today's slap on the wrist for, presumably, ex-Dr Murray, might provide a signal to some others.

It appears to be a popular call on the part of the jury... "Outside the courthouse, the BBC's Peter Bowes said that at the moment the verdict was read, the crowd along the street erupted with cheers and chanting".

And an opinion piece worth considering, by Andrew Cohen of The Atlantic: "Murray did not officially represent the King of Pop for long. But like everyone else in the world he surely knew that he was taking on a patient with a reputation for using drugs to try to tune out the demons which afflicted him. The rest of world envisioned a tragic end for Jackson along these lines. After covering his 2005 molestation trial I certainly did. Why didn't Murray?"

Greed for excessive financial reward, one supposes. I can't imagine he joined the circus in order to be more useful to the world.
