I was recently the victim of a Wrongful Hire case, otherwise known as Negligent Representation. I was given a job offer to entice me to quit my former job only to find out that the manager had lied about the wages, the hours of work and the job description... so pretty much everything. I was really lucky and got my old job back with more hours and a raise or I would have been in one of the many hell pits that exist out there in the labour market trying to dig my way back out.

I've let two months pass since I walked out with no notice from the new job. I wrote a four page letter to the company head office and it is my task tonight to whittle it down to one page that contains only the things they need to know to protect their company name and their employees from this horrid woman. Another former employee contacted me to let me know she's made a complaint to head office as well so it's nice to know that they will have to take my letter more seriously.

I've decided to tell them that, though I have a strong case against them, I will settle for being informed of what action they are taking to make sure this manager is dealt with properly. Aside from the wrongful hire case, she is working employees an hour beyond the legal limit without breaks, she informed me that I would be made to work 60 hour weeks and would be "salaried" for 40, no banking of hours. She doesn't understand that you can't make someone "salaried" to avoid paying overtime and they don't use punch clocks so head office doesn't know anything other than the hours she reports for her staff.

The reason I'm bothering with it at all is because I know the poor kid that they're going to promote to my job and he's said he can't quit as he couldn't find another job. They'll be paying him almost half of minimum wage during the Christmas season.

The trick is to go back, now time has passed, and take all the personal, emotional content out of the four page letter. I'm glad I waited.

Sounds like the manager in question may lack empathy by focusing narrowly on results that she can't see how other's lives are affected by her decisions. It's difficult for upper management to properly weigh the performance and trajectory of such people.

Making them aware of the situation in a calm and reasonable way is the best thing to do.

It is possible that the company put this manager in position because should could do that.

I suggest copying the federal Wage and hour division of your federal department of Labor with this letter.

Next time you hear some politician bleating about how employment law is making it hard for employers to sack poor employees and that the minimum wage is a bad idea I will be sharing your desire to hit them with something.

I'm pretty sure they don't want managers like that. She sent me to another store to train because that manager had been assigned to help her out and the other manager is really cool. Her staff like her a lot.

I'm going to wait for a reply before doing anything else but, thank you, copying the Labour Law people is a good second step if they don't take serious action. I pretty much want her fired and would like to hear they are implimenting better programs to watch how staff are treated, starting with installing punch cards.

I'm not a big fan of unions because of my experiences in film unions but I'm wondering if we need a general "workers union" that represents all employees since the government is doing squat to raise the standard of living or employment in this country. Our current Employment Standards Act has been whittled down to bare basics.

Unions can be a two-edged sword.

I had some fairly bad luck with them when I worked in the food service industry, but when I was in construction, they were very effective.

Letter is officially on its way to Head Office HR now. I don't think it has sunk in yet that I've gotten it done. I just realized I've been fighting a sense of guilt the last two months because I felt I was letting the other employees down by not informing HO of what was going on. Hopefully it will free up that part of my mind that was nagging now.

Spent a couple of hours chatting with another ex-employee of the company. She has made a complaint to Head Office over the phone but decided to put it in writing as they have so far ignored her request to have all her pay stubs mailed to her as that's another thing the manager failed to do properly. She thought her complaint was being logged but realized there was no evidence to suggest they recorded the issues.

There is a certain relief in finding someone who knows the extent of what you mean when you say "It was so bad I was in shock." Neither of us could sleep properly, we went to bed dreading the next morning, woke up with anxiety problems and struggled to get through each day without walking in sudden "take this job and shove it" mode. We both tried to find ways to make the job work and we both started to think there was something wrong with us that made us unemployable.

And, for me, that was just after two weeks.

I hope something good comes out of it.

My daughter-in-law recently went through a very similar thing, but she had to go to the state labor board to get the attention of HQ.

When the smoke cleared, she found herself unemployed, as well, but a call to the Labor board, again, netted her proper references and 3 months' pay for her troubles.

She now has found a job she likes.
