I viewed this at HuffingtonPost and there were a surprising amount of commenters that felt the driver must have been justified in his violence. I can't imagine what the passenger could have said prior to the video that would make a rational person react this way... "rational" being the operative word here.

From what I can make out, he asked one too many questions, or maybe the wrong question too many times. Its assault, pure and simple. No justification from what I saw. I look forward to hearing that he has been sacked, arrested and charged

He's only been charged with a misdemeanor, instead of felony assault and battery. Let me see if I can find a reputable news source on the story.
And his "too many questions" sounded like he was asking what street they were on. Didn't take much, did it?

No amount of stupid questions justifies that beating. Ya kick the guy off the bus and trust that the video will back you up. That's all.

"In the video, Fischer is heard telling his supervisor after the attack that he put the passenger off the bus, and "it wasn't pretty."
Esposito said there were no red flags with Fischer, who had been a driver for StarTran for four years. He was warned once for a traffic violation, and he had a driving under the influence case in 2004 that was dismissed.
Fischer was remorseful during the disciplinary hearing, Esposito said.
The newspaper reported that investigators have been unable to reach the man in the video, who provided an address and phone number to police on the day of the attack."
So the driver did have previous "problems".
The passenger has not pressed charges?

Sorry, violence is never an answer. He could have killed that guy, for what? Talking too much? If I was that guy, I'd have already visited a lawyer and be planning what I'd do with the cash settlement from the city.

Nothing justifies this treatment to others.

No, I meant "thank God the passenger wasn't carrying".
No one is searched boarding a public bus. you pray when your on one..:wah:
Serious though - the driver assaulted a passenger
the passenger did not/could not defend himself.
Driver is lucky the passenger didn't have a weapon.
No this could've been a completely different outcome

Can I just make It clear at this stage that I am not carrying anything and have no Intention of carrying anything. However this Is not to say I may carry If I was given an opportunity to carry. It Is the lack of opportunity to carry that makes carrying for me difficult or though at times I wished I was carrying.

My comment covers both driver and passenger.
Either one and somebody would have died that day.
If the passenger had come prepared, how would the Law treat him if he had leased off a shot or two and injured or killed the driver ?

If the state has that "Stand your ground" law:
"In the United States of America, stand-your-ground law states that a person may justifiably use force in self-defense when there is reasonable belief of an unlawful threat, without an obligation to retreat first. The concept sometimes exists in statutory law and sometimes through common law precedents. One key distinction is whether the concept only applies to defending a home or vehicle, or whether it applies to all lawfully occupied locations.
Under these legal concepts, a person is justified in using deadly force in certain situations and the "stand your ground" law would be a defense or immunity to criminal charges and civil suit."

I sometimes get the impression americans over-think these things trying to cover every option. To me it's simple, you can defend yourself the level of violence used depends on the situation. Easy for me to say though I live in a society where the odds of meeting someone who is armed with a gun and likely to use it are minimal to non existent Maybe the fear he was facing a nutter who might be armed is what drew the response from the driver. (can't hear what was being said I make the comment based on meeting, for want of a better word, nutters who are clearly borderline about being violent. We have mentally ill people living homeless on the streets due to a care in the community policy which basically means they get dumped)

The passenger was doing small talk - something to do with the street coming up next?
Nothing to provoke the Driver to loose it.
The odds of one being armed is high here - that's why I think the Driver is lucky to be alive. Driver was aggressively approaching the passenger.
There is no security boarding a public bus so many could have a weapon - mentally challenged etc.
For all we know this passenger could've just returned from war - protecting our Country to return home on a bus for another war..?

The passenger sounded a little simple minded to me, he was standing on an empty bus too, obviously worrying about missing his stop.
Bus drivers job description includes assisting passengers with information about the stops on their route.
Has the passenger come forward yet ?
Didn't the driver show his behavioural problems to his employer or colleagues ?
Could the Bus company be liable for letting him loose on the public ?

Yes, this could be a expensive law suit - passenger would win $ $ $.
I haven't heard if the passenger has come forward - and with the Boston Bombing that's pretty much the news.
There's a reason for having a camera - if a incident occurs etc.
A Driver has authority over his bus and is responsible for the safety of all.

I wonder where the rest of the recording would be that shows the earlier conversation that got the driver upset to start with.
This guy has that look in his eyes that he is not a deep thinker, and he had no idea that the driver was dangerous, or he would have just shut up and left the bus when he started yelling.
He did not deserve to be treated like that.

Many times if your the only passenger on the bus you naturally chat with the driver.
The only time I use Public Transp. (bus) is in Oahu Hawaii. That Island has the best Bus system in the US.
We buy a Bus pass for the month we're there - and travel everywhere. Our pass fee is $5.00 for a month of unlimited travel.
For $2.50 the bus will take you around the Island - all day trip & well worth it. Go to the North Shore (TurtleBay Resort) relax - have a cocktail & catch the bus returning to Waikiki.
For $2.50 a Public Bus will take you to the entrance of Pearl Harbor- cost of Pearl H. $8.00.
Compared to a Tour bus - charges you $38.00 @person RT & Pearl Harbor fee included in that package. I'll go Public Bus thank you. I could be a Tour Guide.
Nothing can justify the drivers conduct. I wonder what the passenger could've said and I watched again and the passenger was actually questioning like me? what?
and the sad part there was no where for the passenger to go - he didn't & couldn't defend himself - maybe chose not to strike back.?

my reference is Hawaii - my only experience using Public Trans. is in Hawaii and those bus drivers are very very friendly & helpful since the ones with question are usually tourist.
There's way's of telling whether one wants to chat or not.
But that could be a different situation with regular public bus drivers - individual choice I suppose. Some choose to be alone - some crabby - whatever.?
Oscar - this man was the ONLY passenger - stayed close to the driver. Chose to stand as if this would be a short trip.? Asked questions regarding street area?
You wouldn't go to the back of the bus would you? I wouldn't expect 1 person to go too far.

I completely understand the germ thing and some people can be questionable?
some could be those Coal Miners of yours in the UK out of a job.?
I find the bus interesting - I'll be the one starting a chat - I've met some of the nicest people.
I boarded a bus once - driver had a interesting band/bracelet on his wrist so I start a chat about the band and on I went.
During one of his stops the driver walked back to me & handed me the bracelet.
He stated he called his wife & she had one more so he had permission to give it away
This is Hawaii now - not exactly the same situation as in this video.

On public transportation, we are not dealing with the elite of society, but that does not mean those of us who depend on such must put up with such nonsense.
In my experience, a letter of complement, or complaint goes a long way.

I don't take public transport. It's full of nasty working class people full of germs.
You might have no choice soon I see the tories are going to do away with motability cars and replace them with bus passes so that those who work for a living don't get held up by scroungers clogging the roads and end the insistence on special disabled spaces so that those who actually work for a living don't need to walk so far at the supermarkets to do their shopping.

Many times if your the only passenger on the bus you naturally chat with the driver.
In our cities most buses have screens up to protect the drivers from attack and big signs saying do not distract the driver.

I haven't seen our drivers in a protective case - that doesn't mean they don't exist in some cities.?
If that's the case where the driver has to be protected I would imagine that route would be stopped.? or maybe certain bus routes require a security guard on board?
We have flight Marshalls on airplanes during flights
or I should say airplanes are now called a Bus - Air Bus.
Or maybe this cage is to protect the ones boarding the bus - as in this video..!
pretty scary dealing with the public.
