I have tried finding out this on the net but It's a quagmire of legalities.

I've been asked to find out.....

There Is a company selling art and a campaign Is run through this company to raise funds and getting artistes to donate artwork to be sold.

The workers are volunteers but the director of the company buys himself a £75,000 vehicle with the proceeds of this donated art.

As company director, Is he allowed to do this?

I'm no lawyer but I would have thought that it depended on the wording used to persuade the artists to donate and the public to buy.

If there was any suggestion that it was a charitable cause or that the company was a regisered charity then it is likely to be fraud.

If the artists were promised any benefit from the donation that they did not receive then it's breach of contract.

If the reason was unspecified and the artists received all they were promised then he can do what he likes with the profits.

The auction of the donated art was advertised as being for a charitable cause hence the artiste's giving up their artwork.

So It appears there's some kind of embezzlement here.

How do you know for sure that the director of the company buys himself a £75,000 vehicle with the proceeds of this donated art? How can you know he embezzled? You are welcome to spill the beans.

If it was advertised as being a charity then the company should be registered with the Charities Commission who have strict rules as to how much may be taken out of the donations and regulate the way that charitable companies are run.

As part of their blurb you should find a charity registration number, that will let you find the details of the registration :-

I am Indebted Bryn.... Again, Thank you.

As It happens I trawled through all UK registered charities late last night and It Is not registered. I didn't see the site about where to lodge a complaint so I will pass that on to the concerned party so they can take It up themselves.

Then you need a copy of the blurb put out by the company claiming the sale to be for charitable purposes and pass that on to the charities commission - that in itself would put them under investigation.
