BOULDER, Colo. - Home Depot was sued by a shopper who claims he got stuck to a restroom toilet seat because a prankster had smeared it with glue.



Bob Dougherty, 57, accused employees of ignoring his cries for help for about 15 minutes because they thought he was kidding.



“They left me there, going through all that stress,” Dougherty told The (Boulder) Daily Camera. “They just let me rot.”



The lawsuit, filed Friday, said Dougherty was recovering from heart bypass surgery and thought he was having a heart attack when he got stuck at the Louisville store on the day before Halloween 2003. A store employee who heard him calling for help informed the head clerk by radio, but the head clerk “believed it to be a hoax,” the lawsuit said.



Home Depot spokeswoman Kathryn Gallagher said she could not comment on pending litigation.



The lawsuit said store officials called for an ambulance after about 15 minutes. Paramedics unbolted the toilet seat, and as they wheeled the “frightened and humiliated” Dougherty out of the store, he passed out.



The lawsuit said the toilet seat separated from his skin, leaving abrasions.



“This is not Home Depot’s fault,” he said. “But I am blaming them for letting me hang in there and just ignoring me.”

Thats terrible, he must have been sat there a while for the glue to dry so firmly and who would sit on a toiled seat without making sure it was clean. Your supposed to line it with toilet paper if your going to sit on it.

Excellent point Osox, I have been in public Men's rooms, & have seen first hand, guys walk in the stall & just plop down on the seat! Not very sanitary to say the least, so if that guy was not such a slob, that would not have happened to him!!! :wah:

That might be a good argument against his case, it was his own fault.;)

Right again Osox, Rest rooms in the US ( Maybe by you also) provide wax paper rings to put on the seat, prior to sitting on it! :thinking:

I'v only seen those rings on planes when I'v been flying somewhere, but I taught my kids to make one from toilet paper.

Actually this is getting into to much detail, anyway I always try to go at home. But for the few times when I'm stuck out at public men's rooms, I lift the seat with the corner of my shoe, & then just "hover"!!! :o

So I'm never at any risk of getting my butt glued to a seat!!! :D

ok let's look at this in analytical mode....see if it meets the smell test, figuratively speaking of course....a man goes into the loo. he takes a seat. he does not notice it's sticky and gummy . sure. then he sits there long enough for the glue to form a secure bond. oh PULEEEZE!! did anyone look in the trash cans for glue container? hmmmm? this is total finger-in-the-chili-BS, mark my words!! :D i hope his butt is photographed and displayed in large blowups for the depositions. warts and pimples and all. :rolleyes:

Actually when I was a kid and superglue had just come out I brought some home and asked mom to close her eyes while I superglued her fingers together. It was swift.





So was the crack on the back of the head.

Speaking of Clint, I've not seen him posting lately?

Hey, remember I'm the one who's an Obsessive Compulsive "Hand Washer", remember a previous post of mine. I wash my hands between 40 to 50 times a day, every day! I use paper towels to touch every knob, handle, door, etc in the "public" men's room!

You don't think for one minute, that I'm going to park my butt on some filthy, dirty, "germy", diseased, "public" seat, do you? :wah:

Actually, I believe it was 20/20 last week had a report and the toilet

seat is NOT the "dirtiest" part of the public restroom. (Yes, I still use

the paper covers) The dirtiest part is the faucet handle and/or door

handle if they have one. Good job, cars, on using paper towels. If the

door has a handle, I cover my hand with the bottom of my shirt. Going

in or coming out. If it is just a push-type door, I hit it with my shoulder.



I like the newer restrooms where you just hold your hands in front of

the faucet and the water goes on.



(BTW, never seen "waxed" paper covers, just tissue?!?!?!?)

Once again, LC, I have to bow :yh_worshp to your superior BS detectors, but

I have to say, this doesn't seem as far off the mark as the finger in the

chili caper. I can easily see a man sitting long enough to get glued. And

I'm sure if it does go to court, there will be photographs in evidence,

glue pulling off some of your skin is understandable. Why did they bother to

undo the lid and take him to the hospital?



If we ever do find out about this, we can all be happy to say we heard

it from LC first!!

When you think about the progression in rest rooms goes: Finish business, use T-paper, with dirty hands open door latch/handle, with dirty hands touch -open door, with dirty hands touch faucet handle, (if they do wash hands) with semi-clean hands touch paper towel handle, with semi-clean hands touch exit door handle. (Not a pretty picture :wah: )

(BTW, you're right, tissue covers are more common than the "semi"- wax paper ones)

NEDERLAND -- The Boulder County man who claims his rear end was glued to a toilet seat in Home Depot in 2003 today vehemently denied allegations he made a similar report about a toilet seat in a Nederland town visitors' center last year.

In a statement issued today by his lawyer, Bob Dougherty also said he’d be willing to consent to a polygraph test if a news organization organized and paid for it.

His lawyer, Mark Cohen, could not be reached for comment.

On Monday, Ron Trzepacz, Nederland's former director of operations, said from his New York home that Dougherty came to him in the summer of 2004 to complain that his behind had been glued to a toilet seat.

In the 2004 incident, Dougherty, 57, said he was able to pull himself from the seat in the visitors center bathroom, Trzepacz told the Rocky Mountain News.



His verbal complaint made it no further than Trzepacz, who said he personally inspected the bathroom and found no adhesive residue and "no indication that anything had been on the toilet seat."

No police report was ever filed and no medical professionals were called to the site, said Trzepacz, who worked for the town for 13 years.

Monday morning, Dougherty and Cohen made a live appearance on the Today Show.

In an interview with "Today’s" Katie Couric, Dougherty said he was glued to a toilet seat in the Louisville Home Depot for 20 to 25 minutes in October 2003 before help arrived.

Dougherty claims in a civil lawsuit, filed late last month, that store employees ignored his calls for help and failed to maintain the bathrooms by not stocking paper toilet seat covers.

He’s suing for $3 million.

On Oct. 30, 2003, Dougherty said he had a "sour stomach" and rushed to a bathroom stall in the Home Depot. He reached for a paper cover for the seat but found none, the suit said.

Needing to use the restroom urgently, Dougherty sat down anyway.

When he attempted to stand up, he couldn’t.

"His buttocks and legs burned from attempting to get up, and he realized that he was glued to the toilet seat," the lawsuit said.

Dougherty’s suit said he began to panic and thought he was having a heart attack before hearing a store employee enter the restroom.

He reported calling out to the man, who reported the predicament to the head clerk.

But the lawsuit said the clerk did nothing because she "believed it to be a hoax."

About 15 minutes later, another store employee and a friend of Dougherty’s arrived in the restroom. They called an ambulance.

But to Dougherty’s horror, medical personnel weren’t able to loosen him from the seat.

Instead, emergency workers unbolted "the whole toilet seat and lifted it up with me in it out of the stall and then laid me on a stretcher," Dougherty said on the Today Show. "About that point, I had passed out, and the ambulance crew had jumped on top of me and had a difficult time finding a pulse and - and very little shallow breathing, if they could find that." Dougherty said the events of the day have caused him pain, humiliation and financial loss.site map

i'd like to depose the rescue workers. this thing still stinks. if he was glued, he did it. the prior similar transaction/claim does it for me.
