fence problems
again i come to you good people for advice.if a neighbours fence has its posts and the bad side of the fence your side of it is this legal in england?

I was always led to believe that if it was to the right of your property it was your responsibility and you gave the good side to the neighbour. Hence each property would have a good side to left and bad to the right....This may be wrong or have changed im not sure.

we have had the same sort of problem here really, you see we are on the end of a row, so to our right is a wall,, then along the back and other side is fences. The one to the left has the posts on our side and its falling down, in fact i think its only the Ivy keeping it up. Our neighbours said a while back thet it was our fence. some people say to the right is yours, some people say if the posta are in your garden its yours,,,i dunno:oAnyway we are not gonna fall out with neighbours because of a fence so we are going to renew it. the thing is when we renew it the posts will be on their side, otherwise my hubs will have to be in their garden to do all the work
I'm going to the caravan with the dog when he does it, keep out of the way:wah:

thankyou girls very much for you replys.i have been in touch with someone who deals with fences and he has informed me that the posts and and bad side should not be on my side.he also informed me a couple of things that i dident know.oh well your never to old to learn lol.

Tell me then, cos i want to learn too:D i think if our fence is indeed our fence,,, then when we replace it we should keep the posts on our side as it is now ,,, and if i was in my neighbours shoes, i would probably be thinking oi! why have we got the posts now:-5 but i cant get that through to my hubby,,

looks like chez has it right about havinbg a good side and a bad side.i live at te end and have a fence to the right of my garden looking out which is the good side and i have the bad side.i also have thanks to the idiot next door to my left a bad side which cannot be right as his sitting there laugjing with 2 good sides.

Their are also boundaries to take in to consideration. If the fence is on your property its your responsibility, you pay for it and give yourself whatever side you like. Its a bit of a minefield I think. If say you buy a new place and you and your neighbour decide to go halves on the fencing, then the left and right rules applies, apparently lol...Boggling stuff!:-6

:wah:Is'nt it ,, well we own our house and we are buying and putting up the fence,, i just had a look at next dorrs back garden from my bedroom qwwindow, and their other fence hads the posts on their side so if we put it up the way hubs wants to they will have 2 fences with the bad sides

Chris i would maybe try to find out which is your fence and which is not, then you can change your own fence to what you want,,,,,,,,i think:o

Boy, I looked outside at my back fence here, and I have the good side all around on three sides. When I have to replace it, I wonder if I need to do that the same way.

Chris has had to go guys and told me to thankyou for your posts.Basically he put a small lattice fence on top of the one to the left but keeping within the height its meant to be by law.He did it screen them off abit more and as the fence is crap it looks so nice.....they put a note through asking him to move it.The thing is their flipping posts are on this side as he has said and the bad side of the fence......Kaz his right fence is his.Anyway from where Im looking now those posts are on his property......the man at the fence place told us that by right we can use those posts....but feel like saying....ok the lattice will be removed if you put your fence up correctly and within the law.....but is it:-5:-5

Someone should invent a fence with 2 good sides.
If it were me Id probably trellis it or plant attractive shrubs to hide it.
You could stain it, maybe stagger shelves of varying size and heighth and width then place potted plants or flowers on the shelves.
Or you could stand right next to the fence for hours and days on end with only your eyes peering over into his yard until hes so creeped out he agrees to remove the fence entirely.

Here where I live we have the nice part of the fence facing us. But, you're supposed to have that fence a foot into your property line and my neighbor has it a foot into ours instead:wah: don't care as we good buddies.

When putting up a fence, custom dictates that the posts are entirely on your land and the face of the fence, points to your neighbours. It is worth is giving up an inch or two of your land to avoid it going onto next door and creating a dispute. This is especially so since you will need cooperation to be able to repair the fence from your neighbours land. Ensure it complies with Planning Regulations – ring them first.
If you are using Larch Lap fencing, where the panels sit between the posts, then make sure that the entire post is on your side of the boundary and that the top strip overlaps the lower strip on the fact which point towards your neighbours.

well carol is doing a letter right now to the neighbours with this info she said she will put WITHOUT PREJUDICE just incase lol.will keep you informed kaz.

That's what we have in the back on the one side. The other neighbor has his wooden fence facing us on the other side.
