Update on my court case......

I have just had a letter from the solicitor which contained a report from a general surgeon on the cause of my hernia.

The legal team representing the hospital that messed up has said that the hernia occurred because I am overweight, the report has now come back that the cause of the hernia was due to a number of facts;

1) That after the first surgery I was given no antibiotics as a precaution

2) Before being discharged I was complaining of pain and discharge from the wound site

3) After being advised by a top consultant in London not to give me methotrexate they proceeded to do so, a side effect from the drug can be infection

4) 3 days after being discharged I was readmitted via ambulance with severe discharge , high temp and severe discomfort to stomach area

5) Antibiotics were started the following day, where I was diagnosed with cellulitis and septicemia

6) After being discharged 7 days later while still taking oral antibiotics I was readmitted in to hospital with signs of internal bleeding, they took me down for surgery

7) Open opening me up they found dead tissue, 2 litres of blood in the stomach cavity and the other tube was removed



He has summarised the following

After that 1st surgeon operated he made no note of how he closed me and the only notes were a diagram of what he removed, and notes to say that he was unable to perform laparoscopy due to adhesion's and in turn had to do a laparotomy, that was it!!!!!

He has said that although I am overweight it had nothing to do with the reason I had the hernia, it was due to the fact that I had been opened a 2nd time while having a severe infection and the time span in being opened again.

He has also noted that there is a strong chance of the hernia reoccurring, it was very large and it may affect my bowl as the mesh has been attached to the rectum sheath (sorry, that grossed me out too).

I am pleased with the report but also upset, I never knew that I had septicemia, it seems every time I get another report I find even more crap that happened to me during that period!



I don't understand their legal team fighting every single thing, they have admitted fault for the original surgery and thats it, every report that is being prepared is just making them look even worse!

Just one more guy to see now, a psychologist on their side :thinking:

Insurance companies wear the consumer down. They have the time and leisure to wait it out.

You could offer to drop the case in exchange for a part-time position as a surgeon there Suzy. You could scarcely make more of a mess of it than they're doing, it pays well and - who knows - I bet you'd even enjoy the work and you could post pics here of what you'd done. Surgeons started out as barbers and I bet you've cut hair so you can claim experience. That might even be why Jimbo's the way he is!

Suzy Nomie is soooo right. It is what the legal teams hired by Hospitals are paid to do. The will do whatever it take to attempt to make you go away. They have many players, you are 1 person it is a game of wills. :-5

Your in the right here so stay the course and fight them to the bitter end. If they make you an offer you can't refuse take, it or hold out for another offer because that's what is next. Of course I'm speaking from the US side of this. I spent 22 years working in a Hospital I have seen this over and over again.

Of course the first priority is first priority is your health. They need to fix your Hernia.I hope it will be in a first rate Hospital there or ask to be sent somewhere that is know for it excellence in this type of procedure.

I know its mind numbing but stay tuff Suzy..:yh_hugs

Dont let them beat you, they owe you...Simple as.

They get paid megga bucks cos their in a job where their is no room for error.

It is extremely important that you win this case. From what I understand of your situation, the mistakes of the doctors have put you in a position where your medical bills are going to continue to be extensive and they have reduced, if not eliminated, your ability to support yourself due to physical disability.

It is important not just to you, but to your family, that the people responsible provide for your future care.
