If the car was burning, I would do my utmost to get my friend(s) out as quickly as possible. If I couldn't get them out, I would kill them rather than let them experience death by burning.

My hubs employee pulled a woman and her young child from a car that got into an accident last year with an oil truck. He later received a commendation from the police with all the bells & whistles. Pretty neat. Needless, to say he no longer works for hubs.:wah:

Interesting OP, Jimbo. And something that got raised each year in the first aid training classes I had to attend from work. .. The advice about moving someone with suspected back, neck injuries was don't ever do it.. unless you are very very sure that if you don't, there will be a worse outcome.. Then, under Australian law, you were mostly, probably covered. Mostly.. probably...

This employee had no choice as the car did explode after he rescued the occupants.

Yup, I realise that. But I don't carry suicide tabs. I wouldn't do the killing bit for anyone. It would have to be a close friend.

And I would definitely knock them out first.

End of friendship, I think. I'd tell them that if there's a next time, they can save their own ass.

Some years ago, my sister came across an accident which was an artic lorry. It was before the days of seat belt laws and the guy was through the windscreen bleeding very badly from the neck and face. There was nothing else on the road and being in the days before mobile phones. it meant leaving him to find a phone-box to call 999.

She knew that she didn't dare touch him incase she caused spinal or neck injurie's so left him to go find help. By the time the ambulence got there, he had died and she had a really tough time wondering if she could have done something.

What an awful predicament to find yourself in?

In an emergency situation, you just do what needs to be done. You don't think about consequences except for the immediate safety of the friend in peril.

well, i am a nurse and know that if i pass a wreck on the road and there was serious injury or death from lack of emergency care and someone saw me pass by i would be in a heap of trouble..so you are damned if you do and damned if you dont.:-5

What an absolute rottor to sue the person who tried to save their life?

Totally Guppy!!! Hard to know what's best and you'd have to judge each situation. There is one occasion I remember, where I felt it was not a good idea to do the first aid, and I slipped the heck out of there.

If you know the person, other things get in the equation. And I expect you act as fast as you can, out of the best possible motives, and without a single thought for potential legal repercussions.

In cases of car accidents - there may often be insurance companies involved, and in the case in the OP it may in fact be the injured person's insurance company driving this.. going after anyone else they can get who can save them from having to pay up. As Oscar says....

Instead of feeling appreciative that they're still alive because of their friend's heroic efforts, this person is being sued ????!!!!???? That is really sad ! :yh_sad:yh_sad

I mean, I do empathize with that person's paralysis but the friend meant well in saving his friend's life like that. When a car is burning, you have to pull them out fast anyway, otherwise they will just burn to death.

If it was me, I would definitely pull my friend out from a burning car. I couldn't let them just die right in front of my eyes and I didn't do anything about it. If I ignored their dire situation, I would live with that guilt for the rest of my life.

Reading this story makes me sad because this friend who's being sued will probably think twice next time he's faced with a situation where a friend is in danger, and he might think, " No, forget it. I'll just get sued again." Very, very sad ending for such a heroic action on the part of a friend.

Hi Nok! I agree with you that it's a sad case. It seems the car wasn't actually burning, the rescuer just thought it might. I wonder if the court would have decided differently if there had been an actual fire. Legal questions have nothing to do with friendship or even really, right or wrong.
